Q Okay. During that litigation, did you, as Defendants, or your attorney work a fraud upon the Court or commit any illegal acts?
Q You did not? Okay.
A No, we did not.
Q I will refer you to Plaintiffs’ Exhibit No. 2, which states: “You have sworn and managed to convince the Weld County District Court that my earned accrued wage claim was before the Colorado Division of Labor, and, therefore, the Court has no jurisdiction.” Is that true, Mr. Murphy?
A That’s true.
Q Okay. “You have simultaneously sworn and managed to convince the” — “convince the Colorado Division of Labor that my earned accrued wage claim was before the Weld County Court, and, therefore, the DOL had no jurisdiction.” Is that also true?
A As far — to my knowledge, that’s true, yes.
Quoting Denver District Judge Norman D. Haglund, in Stacy Summers v. Texas De Brazil, Denver District Court Case #09CV3147, in relevant part as follows:
“The Colorado wage Claim Act is designed to require employers to pay their employees’ wages in a timely manner, C.R.S. 8-4-103. The policy behind this act is to allow employees a remedy in a local jurisdiction to sue their employer for untimely wages. Morris v. Towers Fin. Corp., 916 P. 2d 678 (Colo. App. 1996). Any person claiming a violation of the Act has the right to bring civil action and
may bring suit without first exhausting administrative remedies. C.R.S. 8-4- 110(2).”
