A Case So Weak, They Had to Lie to Win: Stan Garnett Teams With the Boulder County Probation Dept. to Falsify Presentence Report.
In criminal conspiracy with Greg Brown, Director of the Boulder County Probation Department, District Attorney Stan Garnett allowed Deputy Prosecutor Catrina Weigel to present falsified evidence before the Boulder County District Court at Longmont, CO resident Craig Buckley’s sentencing hearing on July 18, 2014.
In June of 2013, the Weld County District Court raided Buckley’s North Longmont home, because he had refused to give the deed to his house to former employers, Dream Stone, Inc. Ten days later, Buckley’s home was again raided for alleged threatening statements he had made against the presiding Judge in the civil matter, James F. Hartmann. Buckley continues to assert that both raids on his home were illegal, stating that Judge James Hartmann surrendered jurisdiction when he violated Buckley’s Due Process Rights under C.R.S. 8-4-110(2).
Buckley had been wrongfully convicted of felony, “Retaliation Against a Judge” on April 22, 2014, the prosecution provably having used perjured testimony and falsified evidence to obtain the conviction.
Upon conviction, a Presentencing evaluation was ordered by the Court. On May 20, 2014, Probation Officer Meri Miyasaki presided over the interview with Buckley.
“The trial was just rife with perjury; the prosecutor (Catrina Weigel) suborned felony perjury, and Hartmann lied his ass off,” Buckley exclaimed. “I had absolutely no reason to trust any of these corrupt individuals, so I brought a recording device in with me”.
Buckley proceeded to tell Miyasaki that Judge James Hartmann had violated his Due Process Rights under the Colorado Wage Claim Act C.R.S. 8-4-110(2), had fraudulently and maliciously forced him to pay fees for a Motion that no fees were awarded for, and had aided and abetted Class 4 Felony Attempt to Influence a Public Servant when Hartmann illegally, and in violation of his Oath of Office had concealed, aided, and abetted the crime by the civil Defendants.
Buckley further told Miyasaki that Hartmann had also unlawfully proceeded after Buckley had formally challenged the Jurisdiction of the Court to enter rulings which were unsupported by law, and in violation of his Due Process Rights, and had illegally raided his home to force him to provide the deed to his home, and full financial disclosure to his former employers.
Buckley had sued his former employers for wages due at the time of his termination of employment, which according to Colorado House Representative Jonathan Singer, was his right under The Colorado Wage Claim Act C.R.S. 8-4-110(2). Hartmann illegally stripped Buckley of that right, and surrendered Jurisdiction on June 17, 2010. In the three years prior to the illegal raid on Buckley’s home, there had been no proof of continuing Jurisdiction on the record of the Weld County District Court.
Boulder County Probation Department Officer Meri Miyasaki was also informed that Boulder County District Attorney Stan Garnett had been in possession of clear and convincing evidence sufficient to effect the incarceration of Buckley’s former employers, since April, 2011.
On July 15, 2014, three days prior to his sentencing, as stipulated by Colorado law, Buckley received a copy of the Presentence Report. Buckley said, “I had begged that scumbag Stan Garnett for help for 3 years before he illegally raided my home. CDLE Director Ellen Golombek had provided me with irrefutable evidence that my former employers had sworn simultaneously to both the Court, and the CDLE that neither had jurisdiction over my wage claim, because the matter was before the other: it was a felony, my rights were ignored, and I was brutally harassed”.
Buckley’s proven allegations were glossed over in the Presentence Report. James Hartmann’s criminal complicity and lack of Jurisdiction were wholly ignored.
What was present, however, was a confession. A confession that Buckley had threatened Weld County District Court Chief Judge James F. Hartmann. “This is getting to be a real pattern,” Buckley exclaimed. “That bitch reporter from the Longmont Times-Call, P.J. Shields did exactly the same thing, she falsified a confession in that fishwrapper of a paper.”
Buckley was fraudulently “quoted” by Officer of the Court Meri Miyasaki as saying, “It was a meaningless threat to Mr. Hartmann”.
It was admitted to have been a “threat”, but according to Buckley’s audio recording of the entire interview by the Boulder County Probation Dept., no such confession or admission was ever made.
Falsification of an official Court document by an Officer of the Court is a serious criminal offense. Buckley immediately contacted Boulder District Attorney Stan Garnett, and Boulder County Probation Director Greg Brown, both of whom concealed and denied the illegal acts. Buckley filed a Motion For Contempt with the Boulder County District Court, which was wholly ignored by Judge Andrew Hartman. 7.14.2014DMotContempt_Redacted
Buckley concludes, “This Catrina Weigel lied her ass off, falsified evidence, and suborned felony perjury throughout the whole trial, that’s why I fired my attorney. My attorney, Michael Root, had been told (by Congressman Ken Buck) that if he did anything to embarrass the Judge, (Hartmann) he would never practice law again. I wasn’t going to let this lying Weigel get the last perjured word in. This cunt was literally vibrating, just vibrating during the sentencing hearing. You know it was her intent to present some lunging diatribe about my “taking the law into my own hands”, ‘no respect for authority’, etc., so she went after my web postings, which were mainly Court documents proving Judge James Hartmann’s guilt. That sounds more like culpability on her part than lack of remorse on mine”.
To this date, neither Boulder DA Stan Garnett, Deputy Prosecutor Catrina Weigel, Boulder County Probation Director Greg Brown, nor Probation Officer Meri Miyasaki have been disciplined for their involvement in falsification of evidence against wrongfully convicted Craig D. Buckley.
The Government of Colorado, with full knowledge of crime by Judge James Hartmann, Congressman Ken Buck, and Boulder District Attorney Stan Garnett should, rightfully, publicly release all transcripts related to the ongoing crimes of the aforementioned.
